How Long Do I Have to File a Claim?

Ohio has a two statute of limitation on personal injury cases, this means you have two years from the date of your injury to file a claim or you may lose your right to compensation. Ohio has a few exceptions to this two year rule, the first being if the injury victim was under the age of 18 or if they wer under a legal mental disability at the time of the injury. In this case the statute of limitations is two years after the individual turns 18 or their disability is lifted. If the negligent party leaves the state or intentionally attempts to hide to avoid a lawsuit the time they are gone or hidden will most likely not be counted in the statute of limitations.

What Damages Can You Recover in a Personal Injury Case?

There are two main types of compensation, or damages, an injury victim can pursue: economic damages and non-economic damages. Both types of damages compensate for different losses an individual suffers. As the name suggests, economic damages compensate for financial losses as such medical bills, future medical expenses and the inability to work.

These types of damages are also called special damages and are usually easily quantifiable, non-economic damages, on the other hand, are usually difficult to quantify as such they are also general damages. Non-economic damages compensate for abstract suffering such as pain and suffer and mental anguish. Ohio does place a cap on non-economic damages, meaning there is a limit to how much an individual can recover.

There is a third type of damages that can be recovered in some specific circumstances called punitive damages. Punitive damages are usually reserved for cases where the defendant knew their actions would cause harm but proceeded anyway, as such they are not often awarded.
